Acceptable Use Policy

This Acceptable Use Policy (“AUP”) describes prohibited uses of the AtomTech Web Services Website-as-a-Service platform (“Service”) provided by AtomTech Web Services (“AtomTech”, “we”, “us”, or “our”). This AUP forms part of, and should be read together with, our Terms of Service. By using the Service, you agree to comply with this AUP. Violations may result in content removal, suspension, or termination of your account, as described in our Terms of Service.

1. Prohibited Content

You may not use the Service to host, publish, or transmit content that:

  • Is illegal under Kenyan law or the law of any jurisdiction where your website is accessed.
  • Infringes the intellectual property, privacy, or other legal rights of any third party.
  • Is defamatory, obscene, pornographic, or sexually exploitative, including content involving minors.
  • Promotes violence, terrorism, or discrimination based on race, ethnicity, religion, gender, or other protected characteristics.
  • Constitutes fraud, a pyramid/Ponzi scheme, or misleading financial promotions.
  • Facilitates the sale of illegal goods or services, including counterfeit products, unlicensed pharmaceuticals, or controlled substances.

2. Prohibited Technical Activity

You may not use the Service to:

  • Distribute malware, viruses, ransomware, or other malicious code.
  • Conduct phishing, identity theft, or attempts to obtain login credentials or financial information under false pretences.
  • Attempt unauthorised access to any system, network, or account, including other AtomTech customer sites or our infrastructure.
  • Conduct denial-of-service attacks, port scanning, or other activity that disrupts network or server stability.
  • Send unsolicited bulk communications (spam) via email, forms, or any integrated messaging feature.
  • Use automated scripts or bots to scrape, overload, or abuse the Service or third-party services integrated with it.

3. Resource Use

Each subscription plan includes reasonable resource allowances (e.g., storage, bandwidth, page limits) appropriate for standard small business use. You may not:

  • Use the Service primarily for file storage, backup, or media hosting unrelated to your business website.
  • Run background processes, cron jobs, or applications that consume excessive server resources and degrade performance for other customers on shared infrastructure.
  • Exceed the limits of your plan in a way that materially impacts other customers, without upgrading to an appropriate plan.

4. Reselling and Unauthorised Use

Unless you have a separate written agreement with AtomTech (e.g., as an authorised reseller or agency partner), you may not resell, sublicense, or provide access to the Service to third parties as a competing hosting or website-building service.

5. Payment System Misuse

You may not use payment features (e.g., WooCommerce, Pesapal, M-Pesa integrations) enabled through your website to process fraudulent transactions, launder money, or facilitate transactions prohibited under Kenyan financial regulations.

6. Reporting Violations

If you become aware of a violation of this AUP by another user of the Service, please report it to atomtech.services1@gmail.com with relevant details. We will review reports and take appropriate action at our discretion.

7. Enforcement

  • We reserve the right to investigate suspected violations of this AUP, including reviewing website content and account activity as reasonably necessary.
  • Depending on the severity of a violation, we may issue a warning, require content removal, temporarily suspend access, or terminate your account, with or without prior notice, particularly in cases involving illegal content, security threats, or harm to other users.
  • Enforcement action under this AUP does not entitle you to a refund of any fees already paid, except as described in our Refund Policy.

8. Changes to This Policy

We may update this Acceptable Use Policy from time to time to address new risks or requirements. Material changes will be communicated via email or a notice on our websitite. Continued use of the Service after changes take effect constitutes acceptance of the revised policy.
